Terms of Service

You may view and use the website for legitimate purposes connected with our services. You must not misuse it — the Acceptable Use Policy sets out what is not allowed, and it forms part of these terms.

Prices shown on the website are starting points for common projects, not offers. Any estimate we send in response to an enquiry is an indication based on the information you provide. A binding price and scope are set only in a signed project agreement.

If you engage us for a project, a separate agreement will cover scope, deliverables, timeline, fees, payment schedule, revisions, intellectual property and support. Where that agreement and these terms conflict, the project agreement prevails for that engagement.

Projects are invoiced in stages, as set out in your project agreement and on the payments page. Cancellations and refunds are covered by the Refund & Cancellation Policy, which forms part of these terms. If anything in a project agreement or these terms appears to conflict with the Refund & Cancellation Policy on how a refund is calculated, the Refund & Cancellation Policy applies.

The website, its design, text and code are owned by us or our licensors and are protected by law. You may not copy or reuse them except as normal use of the site allows.

For project work, ownership of the final deliverables transfers to the client on payment in full, as set out in the project agreement. We may retain rights in our own pre-existing tools, libraries and know-how, and may describe the work in our portfolio unless the agreement says otherwise.

The website may link to or rely on third-party services (for example our email and anti-abuse providers). We are not responsible for third-party websites or their terms.

The website is provided “as is”. We take care to keep the information on it accurate and current, but we do not warrant that it is complete or error-free, or that the site will always be available.

To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of profit, revenue or data, arising from your use of the website. Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud. Any cap on our liability for a project is set in the project agreement.

These terms are governed by the law of the State of New Mexico, United States, subject to applicable federal law and to any mandatory consumer-protection rights that cannot be waived. Disputes relating to these terms fall under the jurisdiction of the state or federal courts located in Bernalillo County, New Mexico, subject to any mandatory legal rights that cannot be waived. If you are a consumer, you may also have the benefit of mandatory provisions of the law where you live.

We may update these terms from time to time. The version on this page, with the date shown at the top, is the one that applies.
